Judicial Review

The court also has supervisory jurisdiction over the decisions of the administrative decision-makers. Judicial review is often used by the court to exercise supervisory control over the decisions rendered by the administrative bodies by reviewing their decisions and ensuring that they act within the parameters of their power or jurisdiction. Judicial review can be filed either in the Federal Court or Divisional court, depending upon the decisions to be reviewed. If the decision or order to be challenged is made by a federal body, board, commission, or tribunal, then a judicial review has to be filed before the federal court. However, judicial review of the decision or orders of the provincial body has to be filed before the federal court. However, judicial review of the decision or orders of the provincial body has to be filed before the Divisional Court.
In Ontario, judicial review is governed by the Judicial Review Procedure Act (JRPA) and the Rules of Civil Procedure.
